By using brynhall.co.uk you accept these terms. If you do not accept them, please do not use the site.
Content and accuracy
The site describes furniture we make. Because every piece is made to order, images, dimensions, descriptions and specifications are indicative rather than an offer of a particular item.
Photographs cannot reproduce timber colour reliably. Timber and finish samples, which are free, are the proper basis for any decision about colour, and even they are indicative of type rather than an exact reproduction of the boards in your piece.
We take care to keep the site accurate but do not warrant that it is free of errors, or that it will always be available.
Intellectual property
All content on this site, including photographs, drawings, range names and text, belongs to us or our licensors and may not be reproduced without our written permission.
Drawings prepared for a commission remain our intellectual property unless we agree otherwise in writing.

Links to other websites are provided for convenience. We are not responsible for their content.
Liability
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for breach of the terms implied by the Consumer Rights Act 2015, or for anything else which cannot lawfully be excluded or limited.
Subject to that, we do not accept liability for loss arising from use of this website, and we are not liable for loss that was not foreseeable at the time you began using the site, or for loss arising from your use of the site for any business purpose.
Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
Part B — Outline terms of sale for commissioned furniture
Nothing we make is a stock item. Every piece is made from scratch to your specification, which is why these terms differ from those of a shop.
1. Quotations
We quote in writing against an agreed specification: the piece, the timber, the finish, the dimensions, the ironmongery and anything unusual.
A quotation is an invitation to order rather than a binding contract, and is valid for 30 days from its date. After that we may requote, principally because timber prices move.
Prices are quoted in pounds sterling and are inclusive of VAT.
Delivery is included in the price within 150 miles of Mickfield, and on any order over £10,000. Beyond that range delivery is arranged and quoted separately, and surcharges apply for outlying areas, islands and restricted access. Your written quotation is the authority on what is included.
2. Orders and deposits
A contract is formed when we acknowledge your written acceptance of the specification and receive the deposit.
- Deposit payable on order: 50 per cent of the quoted price
- Balance: due seven days before delivery
- Accepted payment methods: card, bank transfer, or against a Xero invoice
Delivery is arranged once the balance has been received in cleared funds.
Please check the specification carefully before accepting it. It is the document we make from.
3. Variations
Changes requested after the order is placed must be agreed in writing, and may affect both the price and the delivery date. Once making has begun, some changes are not possible at all.
This is why we ask you to be difficult at the drawing stage. A moulding is cheap to change on paper.
4. Lead times
Standard designs typically take ten to twelve weeks from order to delivery. A genuine one-off bespoke piece typically adds around four weeks.
These are estimates, not contractual commitments. Timber selection, the length of the current programme and the complexity of a piece all move the date. Time is not of the essence unless we have agreed a specific date in writing.
5. Title and risk
- Risk in the goods passes to you on delivery.
- Title in the goods remains with us until we have received payment in full for them and for any other sums then due from you.
Until title passes you must keep the goods in satisfactory condition, insured against the usual risks for their full price, and identifiable as ours. If payment is not made when due, or if you become subject to an insolvency event, we may require the goods to be returned and, where they have not been returned, enter any premises where they are stored in order to recover them.
6. Delivery and access
We deliver into the room of your choice and assemble beds and large pieces on site. You are responsible for ensuring that there is safe and adequate access, that the route is clear, and that someone over 18 is present.
We give around eight weeks’ notice of a delivery date, and deliveries run on any day of the week.
Where access is doubtful, we will survey it beforehand at no charge. If a piece cannot be delivered because of access we were not told about, or because nobody is present on an agreed date, a failed delivery or re-delivery charge of £450 applies.
Storage of a completed piece at your request is free for the first week and charged at £50 per week thereafter.

7. Natural characteristics of timber
Solid timber responds to its environment for the whole of its life. The following are characteristics of the material and are not defects:
- seasonal movement, including fine gaps appearing at the edges of panels in dry conditions and closing again in damp ones
- colour change with age and light, which affects every timber we use
- knots, medullary ray flecking, colour variation and small shakes in character oak, which is specified precisely because it shows them
- variation in grain and figure between boards, and between a sample and the finished piece
- small variations consequent on hand making
- natural markings and patination in leather

8. Cancellation
Because our furniture is made to your specification, the right to cancel that normally applies to distance and off-premises consumer contracts does not apply.
Regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 disapplies the 14-day cancellation right for the supply of goods that are made to the consumer’s specifications or are clearly personalised. Almost everything we make falls into that category.
The practical consequence is straightforward, and we would rather state it plainly than leave it vague. Once an order is in production it cannot be cancelled, and deposits are not refundable. By that stage timber has been selected, cut and worked to your dimensions, and it cannot be sold to anyone else.
If you tell us before the piece enters production we will do what we sensibly can, but the deposit remains non-refundable. Where an order is cancelled after production has begun, the balance of the price may also fall due to the extent of the work already carried out.
This does not affect your statutory rights if goods are faulty, not as described, or not of satisfactory quality.
9. Guarantee
Our furniture is guaranteed as set out on the guarantee page. In summary:
- the structure — the frame, the carcase and the joints — is guaranteed against defects in materials and workmanship for as long as you own the piece
- the fitting of drawers and doors, the ironmongery and the finish are guaranteed for ten years from the date of delivery
- the guarantee covers the original client and is not transferable to a subsequent owner
- accidental damage, misuse, commercial use, alterations by others, damage caused by unsuitable environmental conditions and normal wear are excluded
- the natural characteristics of timber described in clause 7 are not defects
The guarantee is in addition to your legal rights under the Consumer Rights Act 2015 and does not replace them.
10. Complaints
Ring 01449 710500 or email sales@brynhall.co.uk. Tell us the piece, roughly when it was delivered and what has happened, and send photographs taken in daylight if you can.
One workshop designed, made, polished and delivered your piece, so there is one point of responsibility.
11. General
- Personal information is handled as set out in our privacy notice.
- Events outside our control. We are not liable for delay or failure to perform caused by events beyond our reasonable control, including extreme weather, fire, flood, industrial action, failure of utilities or transport networks, and interruption to the supply of timber or materials. We will tell you as soon as we can and agree a revised delivery date.
- Assignment. We may transfer our rights and obligations under a contract to another organisation, and will tell you in writing if we do. You may only transfer your rights or obligations with our written consent.
- Third party rights. A contract is between you and us. No other person has any right to enforce any of its terms.
- Severance. If any provision is found to be unlawful or unenforceable, the remaining provisions continue in full force.
- Waiver. A delay in enforcing any term is not a waiver of it.
- Governing law. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
